Welcome to OUT β an app for discovering queer events, venues, and places in your city. These Terms of Service ("Terms") are the agreement between you and ALY, the operator of OUT, and they set out the rules for using the app. We have tried to write them in plain, warm language while keeping them legally meaningful. Please read them. By using OUT, you agree to them.
If anything here is unclear, email us at padraig@aly.lgbt and we will explain it in human terms.
1. Who we are
1.1. OUT is operated by ALY, based in Ireland ("ALY", "we", "us", "our"). ALY is not yet registered as a company, so there is no company registration number or registered postal address to give you. We are contactable by email at padraig@aly.lgbt, and that is the best way to reach us about anything in these Terms.
1.2. ALY is the data controller for personal data processed through OUT. How we handle your personal data is described in our Privacy Policy at www.aly.lgbt/privacy, which forms part of these Terms.
2.1. OUT is an iOS app (iPhone, iOS 26 and later) for discovering queer events, venues, and places. Its purpose is to help you find things to do and spaces to be in.
2.2. The shipping version of OUT lets you:
(a) Sign in with Apple β the only way to sign in (see section 5).
(b) Join via an invite / waitlist β before you have an account (see section 6).
(c) Create and edit your profile β display name, username, age, pronouns, gender identity, sexual orientation, bio, photo, city, and interest tags (see section 7).
(d) Discover events, venues, and places β through an interactive map and curated, filterable rails, with detail pages for each item (see section 8).
(e) Use the AI "Ask" / search feature β type a question and get results (see section 9).
(f) Save items β bookmark events and venues to a personal list (see section 10).
(g) Use location, optionally β to see what is nearby on the map (see section 11).
(h) Manage your account in Settings β contact us, sign out, delete your account, and read these Terms and the Privacy Policy.
2.3. OUT is a discovery tool. It is not a ticketing platform, a booking service, or an organiser of the events and venues it lists. We do not run, endorse, or guarantee any event, venue, or business shown in the app.
2.4. We may add, change, or remove features over time. We will try to keep the app working well, but we provide it "as is" (see section 16).
3. Who can use OUT (you must be 18 or over)
3.1. You must be at least 18 years old to use OUT. This is a hard rule. During onboarding we ask for your date of birth, and birthdates that indicate you are under 18 are rejected at sign-up. You may not use OUT, or attempt to create an account, if you are under 18.
3.2. By using OUT you confirm that you are 18 or older and that the information you give us during onboarding is true.
3.3. Access to OUT is currently gated by an invite / waitlist. Being on the waitlist or holding an invite code does not guarantee access, and we may manage the queue at our discretion.
4. Your agreement is with ALY (Apple App Store terms)
Because you get OUT through the Apple App Store, the following terms apply. They are required by Apple and they protect both you and us.
4.1. This agreement is between you and ALY only β not Apple. Apple is not responsible for OUT or its content.
4.2. Licence. Apple grants you a non-transferable licence to use OUT on any Apple-branded device that you own or control, as permitted by the Apple Media Services / App Store Terms of Service ("Usage Rules"). These Terms are between you and us, but your use of OUT must also comply with the Usage Rules.
4.3. Support and maintenance. ALY β not Apple β is solely responsible for providing any support and maintenance for OUT. Apple has no obligation to provide any support services. For support, email padraig@aly.lgbt.
4.4. Warranty. To the maximum extent permitted by law, Apple gives no warranty for OUT. If OUT fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (if any). Subject to that, Apple has no other warranty obligation for OUT, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are ALY's responsibility, to the extent we are responsible under these Terms and the law.
4.5. Product claims. ALY, not Apple, is responsible for addressing any claims by you or a third party relating to OUT or your use of it, including: (a) product liability claims; (b) any claim that OUT fails to conform to a legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar law.
4.6. Intellectual property claims. If a third party claims that OUT or your use of it infringes their intellectual property rights, ALY β not Apple β is responsible for the investigation, defence, settlement, and discharge of that claim, to the extent required by these Terms and the law.
4.7. Legal compliance. You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
4.8. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and on your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

5. Signing in with Apple
5.1. The only way to sign in to OUT is Sign in with Apple. There are no passwords. We do not store any password for you, and Apple handles authentication.
5.2. When you sign in, Apple shares with us: your name (once, the first time), an email address or Apple private relay address, and a stable user identifier. We also receive a token that we store for a single purpose β to revoke the Apple connection when you delete your account (see section 13).
5.3. The name Apple shares is used only to pre-fill your display name. You can change your display name afterwards.
5.4. Keep your Apple ID secure. Activity through your Apple ID and your OUT account is your responsibility.
6. Invite / waitlist
6.1. Before you have an account, you can join our invite waitlist. To do this we collect your email address, an optional phone number, a referral code you can share, who referred you (if anyone), your referral count, and your queue position, status, and invite code.
6.2. Waitlist and invite emails are sent through our email provider, Resend. Every such email includes an unsubscribe link, and you can unsubscribe at any time. If you give a phone number, it is not sent to any email provider.
6.3. Invite codes and referral mechanics are provided as a courtesy. We may change, pause, or end the waitlist or referral system at any time, and an invite code does not entitle you to anything beyond access to OUT when granted.
6.4. Waitlist and referral data is kept on its own schedule, separate from your account data. Details of how long we keep it are in the Privacy Policy (see also section 13.3).
7. Your profile and the content you give us
7.1. In onboarding you create a profile, which you can later edit. It can include: your display name; an auto-generated username; your date of birth; pronouns; gender identity; sexual orientation; a bio; a profile photo; your city; and interest tags.
7.2. Age and date of birth. Only your age is shown on your profile β never your date of birth. Your date of birth itself is stored in a restricted, owner-only table so that we can show your age (never your date of birth) and confirm you are 18 or over at sign-up. It is not visible in your profile, and it cannot be changed later, so please enter it carefully.
7.3. Special-category data. Your sexual orientation, gender identity, and pronouns are sensitive ("special category") personal data under data protection law. We collect them only with your explicit, separate consent β this consent is not bundled into accepting these Terms. You can withdraw consent at any time by editing or clearing those fields, or by deleting your account. Your gender identity and sexual orientation are also copied into a combined "tags" field used to surface events and venues that may be relevant to you. The Privacy Policy explains this in full.
7.4. Licence to display your profile. So that we can run OUT, you grant ALY a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display the content you add to your own profile β including your display name, username, photo, bio, and tags β for the sole purpose of operating and providing the app to you. This licence exists only so we can show you your own profile and use your tags to personalise discovery; it ends when you remove the content or delete your account, except for residual backup copies removed on our normal schedule (see the Privacy Policy).
7.5. Your responsibility for your content. You are responsible for what you put in your profile. You confirm that you have the right to share it (for example, that you own or are allowed to use your profile photo), and that it is lawful.
7.6. Note: in this version of OUT, profiles are not shown to other users. There is no chat, no messaging, and no browsing of other people's profiles or content.
8. Discovery: events, venues, places, ratings, and reviews
8.1. The home of OUT is discovery: an interactive map plus curated, category-filterable rails of queer events, venues, and places. Tapping an item shows a detail page β which may include photos, a description, opening hours, links, ticket links, directions, organiser information, and aggregated venue ratings or reviews.
8.2. Third-party listings disclaimer. The events, venues, places, opening hours, links, organiser details, and any ratings or reviews shown in OUT come from third-party and publicly available sources. We do not create, verify, or guarantee this information. It may be incomplete, inaccurate, or out of date. Events can be moved, sold out, or cancelled; venues can close or change. Always confirm details with the organiser or venue before you rely on them or travel.
8.3. Ratings and reviews are for information only. Any aggregated ratings or reviews are drawn from third-party or public sources and are shown for information only. Users do not submit ratings or reviews in OUT. We are not responsible for the content or accuracy of third-party ratings and reviews.
8.4. Attend at your own risk. Your decision to attend an event, visit a venue, buy a ticket, or engage with any business listed in OUT is yours alone, and you do so at your own risk. We are not a party to any transaction or arrangement between you and any organiser, venue, or business.
8.5. Map and venue data. Some venue and place information shown on the map and in detail pages is supplied by Google Places, a service of Google. To show you these results, venue and place queries are sent to Google Places; no profile information or special-category data is shared with it. Google Places is a US-based service, and these transfers are covered as described in section 15 and the Privacy Policy.
8.6. Directions. When you ask for directions, OUT may open Apple Maps on your device through a standard device link. Apple Maps is provided by Apple under its own terms.
9. AI "Ask" / search
9.1. The "Ask" feature lets you type a query and get results generated with the help of AI. When you submit a query, the text of your query and your city are sent to our AI providers β Anthropic (Claude), Google (Gemini), and Voyage AI β to generate a response.
9.2. Do not type sensitive details into the query box. Because your query is processed by these third-party AI providers, please avoid entering personal, sensitive, or confidential information in your queries. Keep them about what you are trying to discover.
9.3. AI output is a starting point, not the final word. AI-generated results can be wrong, incomplete, or out of date. Treat them as a helpful starting point and verify anything important β especially event details, times, and locations β before relying on it.
9.4. The AI providers are located in the United States. We rely on EU Standard Contractual Clauses and a transfer impact assessment for these transfers, as described in the Privacy Policy.
10. Saved items
10.1. You can bookmark events and venues to a personal saved list. This list is for your own use and is tied to your account.
10.2. Saved items reference third-party listings, so the disclaimers in section 8 apply to them too β a saved item may change, move, or no longer be available.
11. Location (optional)
11.1. Location is optional. If you grant permission, OUT uses your location only to show nearby venues and events on the map.
11.2. Your location is not shared with anyone and is not stored against your profile. You can turn location permission off at any time in iOS Settings.
12. Acceptable use
When using OUT, you agree that you will not:
12.1. Use OUT for any unlawful purpose, or in breach of any applicable law or regulation.
12.2. Misuse, abuse, disrupt, or interfere with OUT, our servers, or our systems β including by attempting to gain unauthorised access, introducing malware, or placing unreasonable load on the service.
12.3. Scrape, harvest, crawl, copy, or extract data from OUT by automated means, or otherwise collect information from the app except as the app normally allows.
12.4. Reverse engineer, decompile, disassemble, or attempt to derive the source code of OUT, except to the extent that this restriction is prohibited by applicable law.
12.5. Infringe our intellectual property rights or those of any third party, or remove, obscure, or alter any proprietary notices.
12.6. Provide false information (including a false age), impersonate anyone, or use OUT to deceive, defraud, or harm others.
12.7. Use OUT to build, train, or improve any product or dataset, or for any commercial purpose, without our written permission. Your licence to use OUT is for personal, non-commercial use only (see section 14.2).
We may suspend or terminate your access to OUT if you breach these Terms or use the app in a way that is harmful, unlawful, or unfair to us or others.
13. Deleting your account
13.1. You can delete your account at any time in the app: Settings β Delete Account.
13.2. Deleting your account removes your data from our backend through a database cascade. We also attempt to revoke the Sign in with Apple authorisation as part of deletion. This is best-effort β if it cannot complete automatically, you can revoke it yourself on your device:
Settings β [your name] β Sign in with Apple β OUT β Stop Using Apple ID.
13.3. After deletion, some residual copies may remain in our encrypted backups for a short period and are removed within 30 days. We may also keep limited safety or abuse records for up to 12 months where we need to. Waitlist and referral data follows its own retention clock (kept for a period after the entry is redeemed or expires, or sooner on request). Full details of what we keep, and for how long, are in the Privacy Policy.
14. Intellectual property
14.1. OUT, including its name, design, software, look and feel, and the curation and arrangement of its content, is owned by ALY or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.
14.2. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use OUT for your own personal, non-commercial use, in line with these Terms and Apple's Usage Rules.
14.3. Content from third parties shown in OUT (such as venue photos, logos, and listings) belongs to its respective owners.
15. Your privacy
15.1. How we collect and use personal data is explained in our Privacy Policy at www.aly.lgbt/privacy. It covers, among other things: the legal bases we rely on; your explicit consent for special-category data; our use of Supabase (EU-hosted, in Frankfurt) for our backend, which stores essentially all of your personal data; our sub-processors; international transfers to US-based providers β the AI providers (Anthropic, Google Gemini, Voyage AI), Google Places, and Apple β under Standard Contractual Clauses and a transfer impact assessment; your rights under the GDPR and the Irish Data Protection Act 2018; and how to contact us or complain.
15.2. You can complain to the Irish supervisory authority, the Data Protection Commission (DPC), 21 Fitzwilliam Square South, Dublin 2, D02 RD28 β www.dataprotection.ie.
16. Disclaimers
16.1. OUT is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind about the app, its content, or the third-party listings, ratings, reviews, or AI-generated results it shows β including any warranty of accuracy, completeness, reliability, fitness for a particular purpose, or that the app will be uninterrupted or error-free.
16.2. Nothing in these Terms excludes or limits any rights you have as a consumer under Irish or EU law that cannot be excluded or limited.
17. Liability
17.1. To the fullest extent permitted by law, we are not liable for: loss or damage arising from third-party listings, ratings, reviews, organisers, venues, or businesses; your decision to attend an event or visit a venue; reliance on AI-generated results; or any indirect, incidental, or consequential loss.
17.2. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
18. Changes to these Terms
18.1. We may update these Terms from time to time β for example, as OUT changes or the law changes. When we do, we will update the "Last updated" date at the top and publish the new version at www.aly.lgbt/terms.
18.2. For significant changes, we will take reasonable steps to let you know. By continuing to use OUT after an update takes effect, you accept the revised Terms. If you do not agree, you can stop using OUT and delete your account.
19. Governing law and jurisdiction
19.1. These Terms are governed by the laws of Ireland.
19.2. Subject to any mandatory rights you have as a consumer to bring proceedings in your country of residence, the courts of Ireland have jurisdiction over any dispute arising out of or relating to these Terms or OUT.
20. General
20.1. If any part of these Terms is found to be unenforceable, the rest remains in effect.
20.2. If we do not enforce a right or provision, that is not a waiver of it.
20.3. These Terms (together with the Privacy Policy) are the entire agreement between you and ALY regarding OUT.
20.4. You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours, for example if our project moves to a new legal entity, in which case we will let you know.
